What can a New York DUI arrest or conviction cost you?
If you are arrested for DUI (Driving under the influence of alcohol or drugs) in New York, you will have to face two separate cases. The first case will take place in criminal court and the second is where the New York DMV will suspend your driving privileges.
New York DWI cases (also known as DUI – Driving Under the Influence) are based on one of two theories:
Violation od DWI "per se" law (which is based only on alcohol level, not driving impairment)
Violation of traditional "common law" theory (where the prosecution must prove that the driver is intoxicated)
DWI Penalties:
New York’s DWI laws are lengthy, complex, strict and severe; the punishments are harsh. New York treats driving under the influence seriously. In the last couple of years New York State has changed the law regarding DUI arrests:
Loss of your drivers license for longer time frames
Fines have increased
Court costs and extensive administrative fees Probation
Jail or State prison
Vehicle impoundment or forfeiture
An ignition interlock device put on your car
Additional Consequences:
The prosecutor’s ability to enter into plea agreements is limited
Will now have a permanent “criminal” record
Lose your job or certain future employment
Commercial driver - lose privilege to drive for at least one year
Insurance rates will skyrocket or insurance companies will cancel your coverage altogether
