Drunk Driving Tests:
A blood sample or a breath sample will be taken to determine the alcohol concentration in a person’s blood. Each test is different and can have conflicting results, such as one test will establish your innocence, while the other test will show intoxication.
The police officer will choose the test that will be used against you; New York States does not allow you to choose.
A snowmobiler who refuses to submit to a test of breath, blood, or urine will suffer a revocation of his or her snowmobiling privileges for at least six months, and will have to pay a civil penalty of at least $200.
In order to be convicted of DUI in New York State, the prosecutor must prove that you were intoxicated at the time you were driving the vehicle. Your blood alcohol content is determined at the time the blood or breath test is administered. This occurs from 30 minutes to several hours after the arrest. This is significant because absorption of alcohol can take from one to several hours after consumption. Consequently, a BAC test reading can reflect a higher or lower result than your actual BAC at the time of arrest.
